The Do’s and Don’t’s (aka Terms of Service)

If you use twavatars through the website, mobile site, mobile application or through any of our services using the Twitter API, these are the rules that you agree to follow by your use of these services. Ladies and gentlemen here are our Terms of Service:

On your side of the fence:

You must have already celebrated your 13th birthday.

You will not use twavatars in order to do anything illegal or just plain bad like harassing other users, threatening anybody, posting obscene, patently offensive, defamatory or copyrighted material that is not your own.

You, and only you, are responsible for the way you behave and the way your account is used on twavatars, so keep it clean. Carefully protect your password so that only you can access your account.

You are the owner and rightsholder of your twavatar. We have no claim for the content that you post to the service.

But in order to backup your original avatar and to provide the rest of the service that you came here to use, you grant us a license to to upload, save, manipulate, manage and distribute your twavatar within the context of our services. Remember that once you post your twavatar, it also goes to live on Twitter. Read "http://twitter.com/tos" their Terms of Service to see what they can do with it.

You can delete your saved twavatars at any time via the settings page. You don't actually have an account with us, you simply gave us permission to access twitter via our service. You can revoke that permission at any time via your twitter account, click here.

We are using twavatars as our trademark, but you can use the word twavatars freely as long as you don't use it commercially without our specific approval.

If you spot a user that is violating any of these rules, we’d like to be told about it. Write to us at "support@twavatars.com". Please be as specific as possible so that we can find and evaluate the violation.

On our side of the fence:

We will be constantly changing and evolving this service and reserve the right to do so without giving your prior notice. This extends even to shutting down the service altogether. Hey, we’re a tiny startup and this is the way things work around here!

We promise never to spam you or allow any other entity to have access to your account or profile details. Ever.

We may want to publish screen shots or create other promotional information about our service. We reserve the right to use your twavatar for that purpose, like on the home page gallery. Let us know if you specifically want to opt out of this.

We cannot patrol and control all the stuff that gets posted on our services, so we do take responsibility for any of it and we can’t be held liable for any content posted by users of the services.

If we determine that you are abusing the service, we have the right to block your access to twavatars.

Privacy stuff

We care about your privacy just as much as we care about our own. We use "http://apiwiki.twitter.com/OAuth-FAQ" Oauth to interact with "Twitter.com", so that your password is never in our possession. We just get a token back from Twitter that gives us access to your Twitter account on your behalf.

We use web analytics software to measure the activity on our services, but we collect no personal information, just generic statistics to help us better understand how people are using the service, to measure our growth and to test new features.

We do use cookies on this website in order to manage your login and to maintain your session. If you disable cookies in your browser, you won’t be able to use the service.

If we ever put ads on the site, we may use other cookies in order to be able to better control what ads you see, how many times you see it or to target the ads to certain geographical territories.

We hate spam as much as you do. As for now, we do not ask for your email address, but if we ever do, we will never sell it or give it away to third parties. We may send you notices of new features, service changes and any other information that we feel you’d want to know about.

If we should come into possession of any of your personal data in connection with one of our services, we will treat it respectfully, carefully and discreetly and will use it only to make twavatars a better service for YOU. Copyright stuff

We respect intellectual property rights and expect you to do the same. As required by law, we have a process in place for responding to alleged copyright infringement.

If you believe that something of yours has been uploaded to twavatars in such a way as to constitute copyright infringement, please provide us with the following details: (1) a physical or electronic signature of the copyright owner or a person delegated to act on their behalf; (2) a full description or identification of the copyrighted work that you claim has been infringed; (3) a full description of the material that you claim is infringing and a reasonable and accurate way for us to locate it; (4) your contact information, including your email address, telephone number with country code and a postal address; (5) your statement that you believe in good faith that use of the material found on our service is not authorized by the copyright owner, its agent, or the law; and (6) your assertion that the information in your notification is truthful, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

When we receive your claim, we will determine whether to take down the content, block the offending user’s account or to do nothing. We have a designated copyright agent for notice of alleged copyright infringement. Please send us both an email and written letter addressed to:

Twavatars Services are Offered “AS-IS”

We take zero, as in zilch, as in not any, legal responsibility or liability for the reliability, security of this service, accuracy of the content on the site, presence of illegal, offensive, infringing or defamatory content posted to the site by users, any harm that may be caused to your computer or loss of data that may occur while accessing our services. This sounds harsh, but if you read the terms of any decent web service, they all have this clause in there. It’s there to protect us from unreasonable claims and things way beyond our control. That’s all.
